TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern access to and use of the Easy Grow website and mobile application (easygrow.firm.in), operated by Thanigai Estates ("Company", "We", "Us", "Our").

By accessing, registering, or making any payment on the Platform, you ("User", "You") agree to comply with and be bound by these Terms. If you do not agree, please discontinue use of the Platform.

1. About Easy Grow

Easy Grow is a digital platform that enables users to:

  • View real-estate plots/projects offered by Thanigai Estates
  • Reserve or book properties
  • Make instalment-based payments toward the purchase price of selected properties
  • Track payment history and receive transaction receipts

Declaration:

Easy Grow facilitates property booking and purchase only. All payments are treated strictly as part-payments toward the purchase of real estate.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Be legally eligible to purchase property in India
  • Provide accurate and complete personal and payment details

We reserve the right to restrict or terminate access if eligibility requirements are not met.

3. Nature of Payments & Property Rights

  • All payments made through Easy Grow are advance or instalment payments toward the purchase of a selected property.
  • Payments do not confer ownership rights until:
    • Full purchase price is paid
    • Sale deed or applicable legal documents are executed
    • Statutory requirements are completed
  • Property availability is subject to confirmation by the Company.

4. User Responsibilities

You agree to:

  • Provide correct personal, contact, and identification details
  • Use only payment methods legally owned by you
  • Make payments in accordance with the agreed schedule
  • Comply with all applicable laws and regulations

You shall not misuse the Platform for unlawful or fraudulent purposes.

5. Payments & Payment Gateway

  • All online payments are processed through Razorpay or another RBI-authorized payment gateway.
  • The Company does not store card numbers, CVV, UPI PINs, or sensitive banking information.
  • Payment gateways operate under their own terms and privacy policies.

The Company is not responsible for:

  • Bank or network failures
  • Payment gateway downtime
  • Delayed or failed transactions beyond its control

A confirmation receipt will be issued for each successful payment.

6. Instalment Schedule & Delays

  • Instalment amounts and schedules vary by project and are communicated to the User.
  • Delayed or missed payments may result in:
    • Late charges
    • Temporary suspension of booking
    • Cancellation of booking as per applicable policy

7. Pricing, Taxes & Charges

  • Property prices are subject to change based on availability and project conditions.
  • Applicable taxes, stamp duty, registration fees, and government charges are payable by the User.
  • Any applicable transaction or gateway charges will be disclosed at the time of payment.

8. Cancellation & Refund

  • Cancellation requests must be submitted through official communication channels.
  • Refund eligibility depends on:
    • Project-specific terms
    • Stage of payment
    • Administrative and legal costs incurred
  • Approved refunds will be processed within 7–14 working days.
  • Refunds will be credited to the original payment source or registered bank account.

Refunds will not be issued in cases of:

  • Fraud
  • Misrepresentation
  • Violation of these Terms

9. No Assurances

  • Property prices may increase or decrease over time.
  • The Company does not provide assurances regarding future value or resale.
  • Users are encouraged to conduct independent verification before proceeding.

10. Prohibited Activities

Users shall not:

  • Engage in unlawful financial activity
  • Provide false or misleading information
  • Attempt to manipulate payment systems
  • Transfer or resell bookings without authorization

Violations may result in suspension, termination, or legal action.

11. Intellectual Property

All content, branding, trademarks, designs, and software related to Easy Grow belong to Thanigai Estates. Unauthorized use is prohibited.

12. Limitation of Liability

To the maximum extent permitted by law:

  • The Company shall not be liable for indirect or consequential losses.
  • Total liability shall not exceed the amount paid by the User in the most recent transaction.

13. Indemnification

You agree to indemnify and hold Thanigai Estates harmless from claims or damages arising from:

  • Misuse of the Platform
  • Breach of these Terms
  • Submission of false information

14. Privacy

User data is handled in accordance with our Privacy Policy, which forms an integral part of these Terms.

15. Modifications

The Company may update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts in Chennai, Tamil Nadu shall have exclusive jurisdiction.
